520 3 |a The rapid expansion of e-commerce has intensified concerns over user data protection, leading nations to establish regulatory frameworks worldwide. This paper compares the European Union's Digital Services Act (DSA) and the Philippines' Internet Transactions Act (ITA), each designed to protect consumer data in online transactions. Despite shared objectives, these frameworks differ significantly in scope, regulatory focus, and effectiveness due to diverse technological, cultural, and economic contexts. The study examines how each law regulates consumer data privacy in e-commerce, highlighting key distinctions and similarities in policy objectives, enforcement mechanisms, and cultural influences. The study seeks to answer the following questions: How does the EU's Digital Services Act (DSA)regulate consumer data privacy and protection in e-commerce? How does the Philippines' Internet Transactions Act (ITA) address consumer data privacy and protection in e-commerce? What are the similarities and differences between the DSA and ITA regarding consumer data privacy and protection? Employing a comparative legal analysis, the findings reveal that the DSA, built within the EU's single market, emphasizes transparency, accountability, and content moderation, especially for large tech platforms.In contrast, the ITA focuses on fraud prevention and consumer trust, reflecting the Philippines’ developing digital infrastructure and prioritizing transaction security. The DSA reinforces GDPR principles, while the ITA aligns with the Philippines’ Data Privacy Act, with both facing enforcement challenges—varying national enforcement for the DSA and resource constraints within the Philippines' Department of Trade and Industry for the ITA. This study sheds light on the complexities of e-commerce regulation and the role of cultural and economic contexts in shaping adequate consumer data protection.
